In the Shraddha Walkar murder case, the Delhi High Court has instructed Tihar Jail authorities to permit Aaftab Amin Poonawala, the prime accused, to spend eight hours outside his solitary cell each day.

The directive came from a bench led by Justice Suresh Kumar Kait in response to a petition filed by Poonawala, who argued against being kept in solitary confinement under the pretext of security concerns.

Poonawala’s counsel highlighted that while other inmates are allowed eight hours of outdoor time, Poonawala is only granted one hour in the morning and one in the evening.

Responding to the petition, the court ordered Tihar Jail to unlock Poonawala for eight hours daily, aligning with the privileges granted to other prisoners. However, he will still be confined to a solitary cell during nighttime.

The jail authorities justified Poonawala’s isolation citing threat perception. Subsequently, a trial court has framed charges of murder and evidence tampering against him.

The court’s decision aims to balance security concerns with the rights of the accused in the ongoing legal proceedings.
