The All India Bar Association (AIBA) Chairman and President of the Supreme Court Bar Association (SCBA), Dr. Adish Aggarwala, has called for a reevaluation of the judgment regarding the disclosure of corporate donors’ identities and contributions in the electoral bonds scheme.
In a letter addressed to the Chief Justice of India (CJI), Dr. Aggarwala expressed concerns about the potential repercussions of revealing the names and donation amounts of corporate donors. He argued that such disclosure could make corporates vulnerable to victimization, especially by political parties that received lesser or no contributions from them.
Dr. Aggarwala emphasized that corporate donors had contributed under the assurance of confidentiality, as promised by the scheme. This confidentiality clause aimed to shield donors from harassment by other political parties.
The issue was brought before a five-judge bench, with Chief Justice Dr. DY Chandrachud instructing Dr. Aggarwala to raise the matter again during the upcoming session.
Dr. Aggarwala letter highlighted that the previous judgment did not adequately address the substantial legal questions raised. He called for a review of the ruling to consider the points outlined in his letter, which were not adequately addressed previously.
The concerns raised by Dr. Aggarwala revolve around potential infringements on the principles of free and fair elections and citizens’ right to information as enshrined in the Constitution.
Overall, the letter underscores the importance of revisiting the judgment to ensure the protection of corporate donors’ interests while upholding transparency in electoral processes.
