“No lawful right to be in occupation”: Supreme court order to AAP, vacate the office

“After 2017, you have no lawful right to be in occupation,” Court to Aam Adami Party during the hearing.

On Monday, the top court directed the Aam Adami Party (AAP) to vacate the office at New Delhi, plot meant for the Delhi judiciary, by 15 June 2024, so that the land allotted for expanding the district judiciary footprint can be utilized for that purpose.

“In view of the impending elections, we grant time till 15 June 2024 to vacate the premises so that the land which has been allotted for the purpose of expanding the footprint of the district judiciary can be duly utilized on an expeditious basis”, said the court.

The Court also granted permission to the AAP to apply to the Land and Development Office (L&DO) of the Government of India for the allocation of alternative land. The Court instructed the L&DO to review the application in accordance with the law and inform the AAP of its decision within four weeks. Additionally, the Court noted in its order that the Delhi High Court urgently requires premises to accommodate new recruits, as courtrooms are unavailable. As the MTNL building, previously proposed for this purpose, has been deemed unsuitable, the Court directed the Chief Secretary of the Delhi Government to propose an alternative location within two weeks and communicate it to the Chief Justice of the High Court.
