The Enforcement Directorate (ED) had lodged a complaint against senior Jharkhand Mukti Morcha (JMM) leader, alleging that he did not comply with seven summonses for investigation. The first summons was issued on August 14 of the previous year.
A court in the area has summoned imprisoned former Jharkhand chief minister Hemant Soren for next month, considering him prima facie guilty of disregarding notices issued to him by the Enforcement Directorate related to a money laundering investigation linked to an alleged land grab case.
The complaint is filled against the senior JMM leader sometime back, saying he had failed to join the investigation under seven summonses issued to him, the first being on August 14 last year.
The ED has stated in its complaint that Hemant Soren should be prosecuted under Section 174 of the Indian Penal Code for non-attendance in obedience to an order from a public servant.
Soren was arrested by the Enforcement Directorate on January 31 over money laundering allegations following a second round of questioning at his official residence in Ranchi. He resigned from his position as chief minister before his arrest. The 48-year-old JMM leader is currently in judicial custody.
Based on the complaint from the ED and the evidence presented, the court of Chief Judicial Magistrate Krishna Kant Mishra stated in its order issued on Monday that a prima facie offense under Section 174 of the Indian Penal Code is established. The court found sufficient grounds for further proceedings under Section 204 of the Code of Criminal Procedure against accused Hemant Soren.
“Office is directed to issue summons for appearance of accused person,” the court said and fixed April 3 as the date of appearance of Soren before it.
